This presentation provides insights into the role of labour law in shaping workplace justice in Vietnam from factory workers' resistance against managerial abuse and exploitation. While most existing analyses have evaluated the labour law in Vietnam from institutional and regulatory perspectives, little attention has been paid to workers' perception of the law and whether and how they turn to law to demand justice. Drawing from interviews with workers and a close analysis of their letters and petitions to the unions and state authorities in an industrial province in the south, this research examines how law and the morality of workplace behaviour constitute workers' ideals of justice and in turn generate their action. Such morality is grounded in socialist ideology and widely held norms within society, as well as ideals and values embedded in labour law. This research demonstrates that state law matters more to shaping social consciousness and resistance in socialist regimes than has been suggested in conventional scholarship, but it is not everything.
Tu Nguyen is a Research Fellow at the Centre for Governance and Public Policy, Griffith University. Her research interests are in the field of sociology of law and legal reform, with a particular focus on the way law shapes and informs daily survival in socialist regimes. Her book Workplace Justice: Rights and Labour Resistance in Vietnam has been recently published with Palgrave Macmillan.
