With accountants clearly in the firing line in the government's pre-legislation media releases, what is the new Treasury Laws Amendment (Combating Illegal Phoenixing) Act all about? Coming into force on 18 February 2020 the new law has creditor defeating dispositions, changes to DPNs (Director Penalty Notices), restrictions on director resignations, but no definition of phoenixing. Is this the end of good faith restructuring? Come along and find out.
